1. Who We Are
EUROBOOKSTUDIO OÜ (Estonia), registration code 17425011, registered address: Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152 (the “Company”). “MagicTale” is the Company’s brand and the name of our platform for creating personalized children’s storybooks using artificial intelligence. In these Terms, “MagicTale”, “we”, “us”, and “Seller” refer to the Company. We create and sell personalized children’s books (“Products”) through our website and related interfaces (the “Platform”).
By accessing, browsing, or placing an order through the Platform, you agree to these Terms and Conditions (“Terms”). If you do not accept the Terms, please do not use the Platform.
2. Definitions
“User” or “Buyer” means any natural or legal person who uses the Platform, creates an account, and/or places an order. “Product” means a personalized children’s book created based on parameters provided by the User (name, design options, etc.). “Platform” means the MagicTale website and all related services for ordering, payment, production, and delivery.
3. Access to and Use of the Platform
3.1 Access
We aim to keep the Platform available continuously, but we reserve the right to perform maintenance, updates, and changes that may temporarily restrict access.
3.2 Prohibited Use
You may not use the Platform in violation of the law, to infringe the rights of third parties, to upload illegal, abusive, defamatory, discriminatory, or otherwise inappropriate content, or to attempt scraping, reverse engineering, automated data collection, or interference with the operation of our systems.
3.3 Age Restrictions
Orders may be placed only by persons aged 18 and over. Persons under 18 may use the Platform only with the consent and under the supervision of a parent or legal guardian.
4. Registration and Account
For your convenience, registration is performed automatically during checkout, and you will remain signed in on your current device. You may access your profile at any time to set an email address and password, allowing you to access your account from other devices.
During automatic registration, we do not store any payment details in our database. By default, a username of “User” is created, which you can change in your profile. You may optionally add an email address, password, and delivery address so you do not need to re-enter them for future orders. We do not store bank card numbers or other sensitive payment credentials, and our profiles do not contain fields intended for such information.
If you do not set an email and password, you will not be able to sign in to the same account from another device; on the current device, you will remain signed in until you log out manually.
You may request the deletion of your account and all associated data, including delivery details and uploaded content (such as photos), at any time by contacting us at support@magictale.eu. You can also create an account manually via /signup and sign in via /signin.
5. Orders and Payment
5.1 Ordering Process
Orders are placed via a standard checkout process, where you must provide: your first and last name, phone number, email (optional), and delivery address. If you choose to pay by card, you will enter your details directly into the secure payment module of our payment provider (e.g., Revolut Pay or Stripe). Payments are processed directly by the provider; we do not process or store your card data.
5.2 Currency
We primarily operate in EUR and USD, as well as in other local EU currencies where applicable. If your bank or card issuer performs a currency conversion, any related fees are your responsibility.
5.3 Invoicing
All prices are final (including VAT where applicable). Where required, we issue a purchase document/invoice in accordance with applicable law.
6. Production and Delivery
6.1 Production Time
Producing a personalized book takes between 1 and 3 business days, depending on order volume. Orders paid online are given priority, and we aim to produce them within 1 business day.
6.2 Handover to Courier and Delivery Times
After production, the book is packaged and handed over to a courier. Delivery within the EU typically takes 1–3 business days after dispatch. Delivery timeframes depend on the courier’s workload and procedures and are the responsibility of the courier.
6.3 Coverage
We deliver throughout the European Union.
6.4 Risk and Title
The risk of loss or damage transfers to the customer upon handover of the shipment to the courier. Title transfers upon full payment.
6.5 Delay, Loss, or Damage
If your shipment is delayed, lost, or damaged due to the courier’s fault, please contact us. We will assist in resolving the issue and will send a replacement copy once the loss or damage during transit has been confirmed.
7. Prices and Fees
7.1 Price Changes
Prices may change periodically (due to seasonal offers, promotions, etc.) at the Seller’s sole discretion.
7.2 VAT and Final Prices
The prices displayed are final for the customer and include VAT (where applicable). No additional fees are due, except for delivery costs where applicable.
7.3 Delivery
Delivery costs are borne by the customer unless free delivery is explicitly advertised on the Platform as a special offer.
8. Content and Intellectual Property
8.1 Rights in the Platform and Products
The Platform design, illustrations, templates, generated books, and all materials created using our software and artificial intelligence algorithms are the exclusive intellectual property of the Company. All rights are reserved. Copying, distribution, modification, or resale is strictly prohibited without our prior written consent.
8.2 Customer-Provided Materials
By providing personalization data (names, texts, images, etc.), you declare that you possess all necessary rights to use them and that they do not infringe upon the rights of any third parties. You grant MagicTale a non-exclusive license to reproduce, process, and use such materials solely for the purposes of producing, printing, and delivering your order, as well as for related customer service (including quality assurance and support).
8.3 Prohibited Content
We do not accept materials that are illegal, pornographic, incite hatred or violence, infringe intellectual property rights, or are otherwise inappropriate for a children’s audience.
9. Returns, Refunds, and Our 30-Day Guarantee
Extended 30-Day Return Policy
Standard consumer protection laws grant you a 14-day window to request a return. However, we want to ensure your complete satisfaction, so we have extended our return period to 30 calendar days from the date of delivery. This means we can process a refund for you even if you contact us after the initial 14-day period.
Please keep in mind that our books are personalized and custom-crafted specifically for you. For this reason, returned items cannot be resold and are typically destroyed upon return.
If your book arrives with a manufacturing defect, or is damaged or lost in transit through no fault of your own, we will gladly replace it free of charge once the necessary checks are completed.

10. Limitation of Liability and Force Majeure
We are not liable for temporary Platform outages, technical malfunctions, courier delays, or errors resulting from inaccurate data provided by the customer. To the maximum extent permitted by applicable law, our total liability to you arising out of or relating to a specific order is limited to the value of that order.
We shall not be held liable in cases of force majeure (e.g., natural disasters, war, strikes, or interruption of supplies/services by third parties).
11. Privacy and Personal Data
We process personal data solely for the purposes of fulfilling orders and providing customer service, in strict accordance with our Privacy Policy published here: /privacy-policy. Bank and card payment data is entered directly into and processed by our payment providers; we do not store this information.
12. Governing Law, Disputes, and Out-of-Court Resolution
These Terms are governed by and interpreted in accordance with Estonian law, without prejudice to any mandatory consumer protection rules in your country of residence (if you are an EU consumer).
In the event of a dispute, we encourage you to contact us first to seek an out-of-court resolution. You may also utilize EU-wide consumer protection mechanisms via the European Commission's Online Dispute Resolution platform: https://commission.europa.eu/index_en. For customers in Bulgaria, you may contact the Consumer Protection Commission: https://kzp.bg/. The competent court will be determined in accordance with applicable procedural rules. 13. Changes to the Terms
We reserve the right to update these Terms at any time by publishing a new version on the Platform. Your continued use of the Platform after such changes are posted constitutes your acceptance of the updated Terms.
